Art Source Home offers optional customer accounts. Guest checkout is available, and no account is required to make a purchase. Creating an account allows you to track orders, manage your shipping addresses, and access your order history. If you choose to create an account:

• You agree to provide accurate, complete, and current registration information and to update it as necessary;
• You are solely responsible for maintaining the confidentiality of your account credentials;
• You are responsible for all activity that occurs under your account;
• You agree to notify us immediately at customerservice@artsourcehome.ca if you suspect unauthorized use; and
• You may not transfer, sell, or assign your account to any third party.

We reserve the right to suspend or terminate your account at any time, without notice, if we reasonably believe it has been used in violation of these Terms or to facilitate fraudulent activity. Termination does not affect any completed purchases, pending refunds, or other rights that survive termination.

Account Deletion

You may request deletion of your account at any time by contacting us at customerservice@artsourcehome.ca with the subject line "Account Deletion Request." Certain information may be retained where required by law or for legitimate business purposes such as fraud prevention, dispute resolution, and legal compliance.

4 Intellectual Property Rights

All content, trademarks, logos, graphics, text, images, designs, software, and artwork on this Website are owned by or licensed to Art Source Home and are protected under applicable intellectual property laws. The name "Art Source Home," all associated logos, and the overall look and feel of this Website constitute proprietary trademarks and trade dress of Art Source Home. Except as expressly authorized in writing, you may not:

While we make reasonable efforts to maintain accurate and current information, we make no representations or warranties regarding the completeness, accuracy, or reliability of any Website content. Any reliance on Website information is at your own risk. We do not guarantee that the Website will always be available, uninterrupted, or error-free. You may not attempt to gain unauthorized access to the Website, its systems, or related infrastructure.

6 Purchases and Payment

When you place an order, you agree to provide accurate, current, and complete purchase information. All orders are subject to acceptance and availability. Art Source Home reserves the right to refuse, cancel, or limit any order at its sole discretion, including where we suspect fraudulent activity, resale activity, or misuse of promotional codes. The following terms apply to all purchases:

• Payment Methods: We accept Visa, Mastercard, American Express, Shop Pay, PayPal, and Google Pay. Payment is collected in full at checkout.
• Shop Pay Installments: Pay-over-time options may be available through Shop Pay, subject to eligibility and Shop Pay's terms.
• Currency: Prices are displayed and charged in USD or CAD depending on your selected region.
• Taxes: Applicable taxes are calculated and collected at checkout based on your shipping address.
• Pricing Errors: We reserve the right to correct pricing errors and cancel orders placed at an incorrect price. A full refund will be provided in such cases.
• Fraud Review: Orders may be subject to security review. We reserve the right to cancel orders we reasonably believe are fraudulent and to notify relevant authorities where appropriate.
• Order Cancellation: Orders may be cancelled within 24 hours of placement, provided production has not commenced. Customized or printed-on-demand orders cannot be cancelled once production has begun.
• Quantity Limits and Reseller Restrictions: We reserve the right to limit quantities on any product. Purchase of products for commercial resale is strictly prohibited without our prior written consent.
• Secure Checkout: All transactions are processed through a secure, encrypted checkout. Art Source Home does not store full payment card details.
• Chargebacks: We encourage you to contact us at customerservice@artsourcehome.ca before initiating a chargeback. Art Source Home reserves the right to dispute chargebacks we reasonably believe are fraudulent, abusive, or inconsistent with our published policies.

7 Shipping and Delivery

Art Source Home ships to addresses across Canada and the United States. We do not ship to P.O. boxes; a physical street address is required.

• Free Shipping: Orders over $100 USD or $140 CAD (net of discounts, before taxes) qualify for free standard shipping.
• Delivery Estimates: All shipping timelines are estimates only and are not guaranteed.
• No Cross-Border Duties: Orders are fulfilled from the hub closest to your destination, so Canadian and U.S. customers incur no cross-border duties or customs delays.
• Address Accuracy: You are responsible for ensuring your shipping address is correct at checkout. Art Source Home is not responsible for orders delivered to an incorrect address you provided.
• Damaged or Lost Shipments: If your order arrives damaged, photograph the outer packaging and the artwork, then contact us at customerservice@artsourcehome.ca within 48 hours of delivery. Retain all original packaging until the claim is resolved.

8 Returns and Exchanges

We want you to love your new artwork. If a piece does not quite fit your space, we are here to help.

• Return Window: You have 14 days from the date of delivery to initiate a return. Contact customerservice@artsourcehome.ca within this timeframe. All returns require prior authorization; unauthorized returns may be refused.
• Condition: To be eligible for a full refund, artwork must be returned in its original condition and original packaging.
• Return Shipping – Change of Mind: The buyer is responsible for the cost of return shipping and insurance.
• Return Shipping – Damaged or Incorrect Items: If your artwork arrives damaged or is not what you ordered, Art Source Home will cover return shipping and provide a full refund or replacement.
• Non-Returnable Items: All products from our customizable collection are Final Sale and cannot be returned or exchanged, except in the case of damage or incorrect fulfilment.
• Refunds: Approved refunds are processed to your original payment method within 5 to 7 business days of our receipt and inspection of the returned item.

Product colours, dimensions, framing, hand-embellishments, and other characteristics may vary slightly from Website images and descriptions due to screen calibration, lighting, and manufacturing tolerances. These variations are not considered defects. Additional return conditions are set out in our Return Policy.

Custom Artwork Approval

Customers are responsible for reviewing and approving all customization details before submitting an order. Art Source Home is not responsible for errors in customer-provided customization information once production has commenced.

9 Pricing and Product Availability

Pricing, product descriptions, and availability are for informational purposes only and do not constitute a binding agreement unless expressly confirmed in an order confirmation issued by Art Source Home. We reserve the right to modify, suspend, discontinue, or update services, pricing, products, and Website content at any time without notice. Product availability is not guaranteed. Art Source Home shall not be liable to you or any third party for any modification, suspension, or discontinuation of any product or service. Products shown as available may become unavailable prior to order processing due to inventory synchronization delays; in such circumstances, Art Source Home reserves the right to cancel affected orders and provide a full refund.

10 Promotional Codes, Discounts, and Offers

From time to time, Art Source Home may offer promotional codes and discount offers. The following terms apply:

• Eligibility: Promotional offers are subject to eligibility requirements specified at the time of issuance.
• One Code Per Order: Only one promotional code may be applied per order. Codes may not be combined or stacked.
• No Cash Value: Promotional codes have no cash value and may not be redeemed for cash or store credit.
• Expiration: Promotional codes are subject to expiration dates and will not be honoured after expiry.
• Prohibited Conduct: Misuse, duplication, transfer, or fraudulent redemption of promotional offers is prohibited. Art Source Home reserves the right to cancel any offer and cancel orders where misuse is suspected.
• Changes: Art Source Home reserves the right to modify, suspend, or terminate any promotional offer at any time without notice.

11 Reviews and User-Generated Content

Art Source Home may permit customers to submit product reviews, ratings, photographs, and other user-generated content ("UGC"). By submitting UGC, you represent and warrant that you are the original author or have all necessary rights, the content does not infringe any third-party rights, and the content is accurate, lawful, and does not contain defamatory or harmful material.

By submitting UGC, you grant Art Source Home a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce, adapt, publish, and display the UGC in any medium, including for marketing purposes, without compensation to you. You may not submit reviews that are false, fabricated, or submitted in exchange for undisclosed compensation. Art Source Home reserves the right to remove or reject any UGC at its sole discretion without notice or liability.

12 User Submissions

Any inquiries, comments, feedback, or other materials submitted through this Website (other than product reviews governed by Section 11) may be used by Art Source Home for legitimate business purposes, subject to our Privacy Policy. Unless otherwise agreed in writing, submissions are deemed non-confidential and non-proprietary, and you grant us a non-exclusive, royalty-free, worldwide licence to use, process, and reproduce such submissions for business purposes.

16 Disclaimer of Warranties

This Website and all content, services, and functionality are provided "as is" and "as available." To the maximum extent permitted by applicable law, Art Source Home disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. Nothing in this section excludes any statutory warranties that cannot be disclaimed under applicable consumer protection legislation.

17 Limitation of Liability

Risk of loss and title to products pass to the purchaser upon delivery to the shipping address provided at checkout, as confirmed by the carrier's delivery records.

To the maximum extent permitted by applicable law, Art Source Home, its affiliates, directors, officers, employees, contractors, agents, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of this Website or the purchase of products through it, including loss of revenue, profits, data, goodwill, or business interruption, however caused and regardless of the theory of liability.

In all cases, Art Source Home's maximum aggregate liability shall not exceed the total amount paid by you for the specific product or service giving rise to the claim in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under applicable law.

18 Indemnification

You agree to defend, indemnify, and hold harmless Art Source Home, its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, and reasonable legal fees arising out of or relating to: (a) your violation of these Terms; (b) your misuse of the Website or any product purchased through it; (c) your submission of inaccurate, unlawful, or misleading content; (d) your violation of applicable law or any third-party rights; or (e) any chargeback or payment dispute incurred by Art Source Home as a result of your actions. This obligation survives termination of your use of the Website.

19 Force Majeure

Art Source Home shall not be liable for any delay, failure, or non-performance of its obligations resulting from events beyond its reasonable control, including natural disasters, supply chain disruptions, internet outages, government actions, labour disputes, pandemics, and similar events. Where a force majeure event affects our ability to fulfil an order, we will make reasonable efforts to notify affected customers and, where the delay is expected to be substantial, offer the option to cancel and receive a full refund.

20 Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Nothing in this clause limits any mandatory consumer protection rights that apply to you under the laws of your jurisdiction of residence.

In the event of a dispute, the parties agree to first attempt to resolve the matter informally by contacting Art Source Home at customerservice@artsourcehome.ca. If the dispute cannot be resolved informally within 30 days, either party may initiate formal legal proceedings. Any legal proceeding shall be brought before the courts located in Ontario, Canada, except where applicable consumer protection laws require otherwise.

21 General Legal Terms

Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver: No failure or delay by Art Source Home in exercising any right or remedy shall constitute a waiver of that right or remedy.

Entire Agreement: These Terms, together with our Privacy Policy and any legal notices posted on the Website, constitute the entire agreement between you and Art Source Home regarding use of the Website and supersede all prior agreements relating to the subject matter hereof.

Assignment: Art Source Home may assign its rights and obligations under these Terms without notice or consent in connection with a merger, acquisition, sale of assets, or operation of law. You may not assign or transfer any rights or obligations without our prior written consent.
